F02-008-080820-01 TELEPHONE: (850) 921-0808 CONTACT: B. Allman PAGE 1 OF 1 Effective October 1, 2008, HB 137 revises the traffic laws to create a few more penalties. This short bill was particularly focused on unsafe motorcycle activities, but it does include a provision for excessive speed. The new law also provides penalties for the first, second, third or subsequent violations. The Distribution Chart found on the FACC website will be updated to reflect the amounts for the first and second offenses in the Traffic section. The third and subsequent offense is classified as a third degree felony with a $5,000 fine and will appear in the Criminal Traffic section of the chart. New Violations: 316.2085(2) Motorcycle or moped, wheels losing contact with ground This is classified as a moving violation. First Offense: the violator must pay $1,000 plus any other costs assessed for a moving violation. Second Offense: the violator must pay a fine of $2,500, plus any other applicable costs assessed for a moving violation. The person’s driver license must be revoked for a period of one year. Third Offense: the violator will be charged with a third degree felony, punishable as provided in ss. 775.082, 775.083, and 775.084, a mandatory fine of $5,000, and the driver license must be revoked for a period of ten years. (new entries for Distribution Chart—see below) 316.2085(3) Motorcycle or moped license tag improperly affixed This is classified as a moving violation. First Offense: the violator must pay $1,000 plus any other costs assessed for a moving violation. Second Offense: the violator must pay a fine of $2,500, plus any other applicable costs assessed for a moving violation. The person’s driver license must be revoked for a period of one year. Third Offense: the violator will be charged with a third degree felony, punishable as provided in ss. 775.082, 775.083, and 775.084, a mandatory fine of $5,000, and the driver license must be revoked for a period of ten years. Second Offense: the violator must pay a fine of $2,500 plus court costs and the driver license must be revoked for a period of one year. water there is bacteria. In a number of carefully controlled trials,
scientists have demonstrated that if we drink 1 liter of water each

the end of the year we would have absorbed more than 1 kilo of

coli, (E. coli) - bacteria  found in feces. In other words, we are 
consuming
1 kilo of poop.

However, we do NOT run that risk when drinking wine & beer (or 
tequila, rum,
whiskey or other liquor) because alcohol has to go through a 
purification
process of boiling, filtering and/or fermenting.

Remember: Water = Poop, Wine = Health

Therefore, it's better to drink wine and talk stupid, than to drink 
water
and be full of shit

And, do you honestly believe that Bill Gates is going to give you, and everyone to whom you send "his" email, $1000? How stupid are we? Ooooh, looky here! If I scroll down this page and make a wish, I'll get laid by a model I just happen to run into the next day! What a bunch of bullshit. Maybe the evil chain letter leprechauns will come into my house and sodomize me in my sleep for not continuing a chain letter that was started by St Peter in 5AD and brought to this country by midget pilgrim stowaways on the Endeavour. Fuck 'em. If you're going to forward something, at least send me something mildly amusing. I've seen all the "send this to 10 of your closest friends, and this poor, wretched excuse for a human being will somehow receive a nickel from some omniscient being" forwards about 90 times. My latest letter to the sponsor of HB 137

To the Honorable Carlos Lopez-Cantera;

It has been almost a month since I sent you an e-mail regarding HB 137 and you answered me with your blanket reply. I now have groups of over 500 bikers who are up in arms over this bill. All are against this bill and are calling and e-mailing you and thier local reps to voice thier concerns, and the posts and replys that I am getting are all pretty much the same. This bill is wrong. While most all agree with you that stunt riding is not for the highways, this bill is discriminatory due to the fact that it singles out bikers. That alone is enough to enrage us. There are laws to deal with all motorists who treat the roads as race tracks and playgrounds. You can't be serious about not having the same consequence's for all motorists. Another large concern is the forfiture clause, having the government sieze personal property is against our basic principles that this country was founded. What gives you the right? You said ..." part of the process of creating a great law is being open to the ideas of others"...

well so far, the idea of others, is that this is irresponsible government in action. There is not one of us who will support this bill in any way shape or form if it, (a) takes personal property, or (b) singles out motorcyclists. We are all anxiously waiting to see what the "wording" is changed to, before taking the next course of action. That would include, but not limited to, as ideas have suggested, rides to the Capital, petitions, media releases, and as some have suggested, your removal from office. I think that sometimes trying to make a difference in a bad situation is best to leave well enough alone and just enforce the laws that are already in place. I think that if this law does somehow make it into the books, you will just have made a bad situation worse. How many of these riders, who feel they are able to ride as the "best of the best" will pull over if they are going to loose thier bikes. They are going to try to outrun anyone who tries to give chase. That is a fact! I wonder how many people will support this bill when more people will get killed or injured because of it. I know if it was my friend or family who was hurt or killed by someone who was trying to outrun the police because of this bill, I would hold you personally responsible. ...something to really think about isn't it. I am asking you on behalf of all motorists, biker or not, to please pull this bill, it is a lose, lose situation for all concerned. The people who are becoming aware of this bill is now snowballing, and I am going to post this letter and your response to all my groups as I have done with the others.  waiting for your new reply... Obituary for common sense

 My parents told me about Mr. Common Sense early in my life and told me I
would do well to call on him when making decisions. It seems he was
always around in my early years but less and less as time passed by. Today I
read his obituary. Please join me for a moment of silence in remembrance.
For Common Sense had served us all so well for so many generations.
 Obituary
 Common Sense

 Today we mourn the passing of a beloved old friend, Common Sense, who
has been with us for many years. No one knows for sure how old he was
since his birth records were long ago lost in bureaucratic red tape.
 He will be remembered as having cultivated such valuable lessons as  knowing
when to come in out of the rain, why the early bird gets the worm,
life isn't always fair, and maybe it was my fault.

 Common Sense lived by simple, sound financial policies (don't spend
more than you earn) and reliable parenting strategies (adults, not children
are in charge).

 His health began to deteriorate rapidly when well intentioned but
overbearing regulations were set in place. Reports of a six- year- old
boy charged with sexual harassment for kissing a classmate; teens
suspended  from school for using mouthwash after lunch; and a teacher fired for  reprimanding an unruly student, only worsened his condition.

 Common Sense lost ground when parents attacked teachers for doing the
job they themselves failed to do in disciplining their unruly children. It
declined even further when schools were required to get parental consent to
administer Aspirin, sun lotion or a sticky plaster to a student; but could not inform the parents when a student became pregnant and wanted to have an abortion.

 Common Sense lost the will to live as the Ten Commandments became contraband; churches became businesses; and criminals received better treatment than their victims. Common Sense took a beating when you couldn't legally defend yourself from a burglar in your own home and the burglar can sue you for assault.

 Common Sense finally gave up the will to live, after a woman failed to realize that a steaming cup of coffee was hot. She spilled a little in
her lap, and was promptly awarded a huge settlement.

 Common Sense was preceded in death by his parents, Truth and Trust;
his wife, Discretion; his daughter, Responsibility; and his son, Reason.
He is survived by three stepbrothers; I Know my Rights, Someone Else is to Blame, and I'm a Victim.

 Not many attended his funeral because so few realized he was gone. If
you still remember him pass this on. If not, join the majority and do
nothing.

Dear Mr. Davis:

Thank you for taking the time to contact me regarding HB 137, Offenses
Committed While Operating a Motorcycle. I realize some riders have
several concerns regarding my legislation. This bill aims to address
riders of high performance motorcycles that treat Florida's roads and
highways as their own personal stunt track. I am sure you can agree that
popping wheelies at high rates of speeds or any other kind of stunt
riding has no place on Florida's roads. That is the type of reckless
driving this bill seeks to address. The goal of this legislation is to
target stunt riding and prevent motorcycle fatalities.

Currently, it seems HB 137 has been drafted in a way that would affect
all motorcycle riders. I feel that the poor actions of a few riders
should not punish all riders. Subsequently, I am currently working on
language that will amend the bill to clearly address the problem of
motorcycle stunt riding on public roads. The amendment will clearly
define what is considered stunt riding and require a motorcycle rider to
maintain two wheels on the ground at all times. The speeding focuses of
the bill will not stand alone but will rather be in conjunction with
stunt driving.

I recently met with James Reichenbach from ABATE, and after I explained
the true intent of this legislation he told me that he would support it.
I am open to meeting with any person or group to discuss amendments to
the bill. I believe that part of the process of creating a great law is
being open to the ideas of others.

In regards to HB137
I am the Florida state moderator for motorcycle-syndicate.com I am also
a motorcycle enthusiast.
The bill you have filed, HB 137 is discriminatory and "profiles"
motorcyclists in Florida.
I am going to denounce this bill in every way possible.
It predjudicial not to include every motorist on the highway to the same
consequences.
Most of us are responsible riders and have tried hard for the last 20
years to overcome the actions of a few.
There are enough laws to deal with the offenders of these actions
without subjecting motorcyclists to an officers idea of
  what reckless driving is.
and the Idea of losing a motorcycle to an officers whim is unjust.
This bill is irresponsible.
I realize there may be a problem with some sport bike riders in your
area,and I understand the reasoning behind this, but dont use new
legislation to try to control a few when the rest of the community will
suffer.
I hope you reconsider this bill.
Every rider I have spoken with on this issue is against it, and will
contact thier representatives to voice thier concern.

I have never been a political person, but I cant sit back and let our elected officials ram some new legeslation down our throats. Especially laws that threaten our freedom to ride. The new bill HB137 threatens just that. Unless the sponsor of the bill changes the wording like he told me, I will fight this bill to my utmost ability. The thing is, I am only one voice, although I can make it heard, strength comes in numbers. The more of us that get off our asses and let them know that we wont stand for any more of our freedoms being taken away needlessly, the louder that voice is. So get off your ass and lets let them hear the thunder.
